Forward: Email Marketing & SMS “the App” provides marketing intelligence software “the Service” to merchants who use Shopify to power their stores. This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.

Please read this Privacy Policy to learn how we treat your personal information. By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Policy.

Note: This Privacy Policy does not cover the practices of companies we don’t own or control or people we don’t manage.

1. General Provisions

  • Your privacy and the security of your personal data (“Personal Data”) are of utmost importance to us, so we have developed this privacy policy (the “Privacy Policy”), which explains how we process and protect your Personal Data, what your rights we ensure, and provides other information about the processing of your Personal Data.
  • In this Privacy Policy, the term “Personal Data” means any information or set of information by which we may directly or indirectly identify you, such as your name, email address, telephone number, etc.
  • The Privacy Policy applies when you use our tools and resources, available at https://app.tryforward.io (The Platform), you request and use information, services or functionalities available on the Platform (The Services). 
  • We may use specific software to register certain customers or partners (e.g. we may use affiliate management software for registering and managing our Affiliate partners). We want to inform you that our customers or partners will be made aware that we use such platforms upon registration and that such platforms have separate privacy policies.
  • In this Privacy Policy, a representative of the legal person, which registers to the Platform, Partners Portal, uses the Partners Portal Services or Services shall be called a “Customer”. Persons using the Website, Social Accounts, or contacting us shall be referred to as “you” (this definition also applies to the Customer when the specific Section of the Privacy Policy applies to both the Customer and other Data Subjects).
  • The Platform, Website and Social Accounts may contain links to external websites, such as our partner websites, websites promoting our Services. When you follow links to any of these websites, please note that these sites and the services accessed through them have their own separate privacy policies and that we assume no responsibility or liability for this policy or for the collection of Personal Data on these sites. Before submitting Personal Data there or using related services, it is important to review their privacy policy.
  • If you use the Services, Platform, Website, or Social Accounts, subscribe to our newsletters, or contact or address us on any other issues, we assume that you have read and agreed to the terms of this Privacy Policy and the purposes, methods, and procedures for the use of your Personal Data specified therein. If you do not agree with the Privacy Policy, you may not use our Services or otherwise interact with us.
  • Capitalized definitions that are not specifically defined in this Privacy Policy shall have the meanings set out in the Forward Terms and Conditions (the “Terms”), other documentation available at the Platform and Website.
  • This Privacy Policy is subject to change, so please visit the Website from time to time and read the latest version of the Privacy Policy.


    Forward as a Data Controller:
     For purposes of data protection laws, Forward is the “data controller” (or similar term under applicable laws) and is generally responsible for and controls the processing of your personal information collected through your use of our Service. This Privacy Notice applies only to instances where Forward acts as a data controller.

    Forward as a Data Processor:  In providing our Service, our customers may collect data in our products and services, or we may collect data on their behalf, which may include personal information or data about our customers’ end users (“Customer Data”). In such instances, Forward acts as a “data processor” (or similar term under applicable laws), and we have contractually committed ourselves to process Customer Data on behalf and under the instruction of the respective customer, who is the data controller. This Privacy Notice does not apply to the processing of Customer Data and we recommend you read the privacy notice of the respective customer if their processing concerns your personal information.

2. How we collect your data

2.a When you provide Personal Data to us, for example, when you register to and use the Platform, Services, Website, Social, contact us, subscribe to our newsletter, apply for a job position offered by us, etc.

2.b When you install the App, we are automatically able to access certain types of information from your Shopify account like customers, order data, discounts, and more.

2.c When you use our Services, Platform, Website, Social Accounts, such as usage history, your IP address, cookies, preferences, open URL links, etc.;

2.d When we receive Personal Data from other parties, for example, when we receive information from public registers, state or local government institutions or bodies, our partners, other third parties, such as payment institutions, about payments made, etc.;

2.e When your Personal Data, with your consent, is provided to us by other persons, including companies using our Services, for example, when such companies indicate your contacts, refer to you as an authorized person, etc.

2.f Information Collected Automatically

We and our third-party providers and partners collect certain personal information automatically when you visit, interact with, or use our Service.

The Services use cookies and similar technologies such as pixels, clear GIFs, web beacons and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. 

We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). 

We use the following types of Cookies: 

  • Essential Cookies. Essential Cookies are required for providing you with features or services that you have requested. For example, certain Cookies enable you to log into secure areas of our Services. Disabling these Cookies may make certain features and services unavailable.

Retargeting/Advertising Cookies collect data about your online activity and identify your interests so that we can provide advertising that we believe is relevant to you. You can decide whether or not to accept Cookies through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. Tracking technology

We may use the following technologies currently or in the future to analyze how you use the Platform and Website:

Google Analytics: The Website uses a tool called “Google Analytics” to collect information about use of the Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to this Website. We use the information we get from Google Analytics to maintain and improve the Website and our products. We do not combine the information collected through the use of Google Analytics with personal information we collect. Google Ads: Allows the Website to serve you ads and to draw up reports. All this information is anonymous. Data collected by Google Ads is typically stored on a Google server in the U.S. If you don’t want to receive tailor-made advertising and/or want to opt out of Google Inc. cookies, you can turn off Google Inc. advertising settings at the https://www.google.com/settings/ads by changing your settings as needed. In this case, an opt-out cookie may be entered for you. However, if you delete all cookies, the opt-out cookie may also be deleted.

Google Remarketing: Allows the Website to re-serve you ads on Google partner network sites. If you don’t want to receive tailor-made advertising and/or want to opt out of Google Inc. cookies, you can turn off Google Inc. advertising settings at the https://www.google.com/settings/ads by changing your settings as needed. In this case, an opt-out cookie may be entered for you. However, if you delete all cookies, the opt-out cookie may also be deleted.

Mixpanel: We collect personal information such as your email address and your user activity through the use of Mixpanel. Mixpanel’s ability to use and share information is governed by the Mixpanel Terms of Use, available at https://mixpanel.com/terms/, and the Mixpanel Privacy Policy, available at https://mixpanel.com/privacy/. You can opt-out of Mixpanel’s services by clicking on the following link: https://mixpanel.com/optout/

Hotjar: The Website uses Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device’sIP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our Website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user. Facebook Pixels and SDKs: We use Facebook pixels or SDKs, which are tools that provide help to website owners and publishers, developers, advertisers, business partners (and their customers) and others integrate, use and exchange information with Facebook, as such the collection and use of information for ad targeting. Please note that third parties, including Facebook, use cookies, web beacons, and other storage technologies to collect or receive information from your websites and elsewhere on the internet and use that information to provide measurement services and target ads.   • To create and manage your Account or other user profiles.
  • To personalize website content and communications based on your preferences, including targeted offers and ads served through the Services.
  • To process orders or other transactions.To respond to user inquiries and fulfill user requests.
  • To improve and develop the Services, including testing, research, analysis and product development.
  • To protect against or deter fraudulent, illegal or harmful actions and maintain the safety, security and integrity of our Services.

  • We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated, or incompatible purposes without providing you notice.

As noted in the list above, we may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may send you promotional email offers or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us, which helps us improve our Services. We disclose your Personal Data as indicated in the chart above to the following categories of service providers and other parties:

Service Providers: These are third parties that help us provide our Services, including payment processors, ad networks, security and fraud prevention providers, hosting and other technology and communications providers, analytics providers, and contract personnel.

Business and Marketing Partners: We may also disclose personal information with other business and marketing partners with whom we jointly offer products or services, co-market or host events, or who are part of our partner ecosystem. We may obtain your consent where required by applicable law. Our business and marketing partners will use your information in accordance with their own privacy notices. 

Advertising Partners: We may share certain personal information (including information collected through cookies) with our advertising service providers and vendors in order to advertise our Services to you. 

Corporate Transaction: Your Personal Data may also be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part).

Legal Obligations and Rights: We may disclose personal information to third parties, such as legal advisors and law enforcement agencies, regulators, other authorities and other third parties for legal reasons if we reasonably believe that such action is necessary: 

  • in connection with the establishment, exercise, or defense of legal claims; 
  • to comply with laws or to respond to lawful requests and legal process; 
  • to protect our rights and property and the rights, personal safety and property of others, including to enforce our agreements and policies;

We disclose your Personal Data to service providers and other parties for the following business purposes:

  • Auditing related to a current interaction and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity.
  • Debugging to identify and repair errors that impair existing intended functionality.
  • Short-term, transient use of Personal Data that is not used by another party to build a consumer profile or otherwise alter your consumer experience outside the current interaction.
  • Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing services, providing analytic services, or providing similar services on behalf of the business or service provider.
  • Undertaking internal research for technological development and demonstration.
  • Undertaking activities to verify or maintain the quality or safety of a service or device that we own, manufacture (or that was manufactured for us) or control.

With Your Consent: We may disclose personal information about an individual to certain other third parties or publicly with their consent or direction. For example, with an individual’s consent or direction we may post their testimonial on our website or service-related publications. 

6. Data Security and Retention

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. 

For example, the Services use industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of Personal Data you provide to us. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. 

We retain Personal Data about you for as long as you have an open account with us and for six months after termination of your account for archival and billing purposes, or as otherwise necessary to provide you with our Services. 

In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We retain a user’s subscription and purchase history indefinitely for archival purposes.

7. Personal Data of Children

We do not knowingly collect or solicit Personal Data about children under 16 years of age; if you are a child under the age of 16, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 16 years of age, we will delete that information as quickly as possible. 8. Control over your information

  • Email Communications. From time to time, we may send you emails regarding updates to our Services, products or services, notices about our organization, or information about products/services we offer that we think may be of interest to you. If you wish to unsubscribe from such emails, simply click the “unsubscribe link” provided at the bottom of the email communication. Note that you cannot unsubscribe from certain services-related communications (e.g., account verification, confirmations of transactions, technical or legal notices).
  • Messaging Platforms. We may use personal information we collect to communicate with individuals via messaging platforms (such as WhatsApp, Facebook Messenger), including to market to you or offer you information and updates on products or services we think you may be interested in. You can unsubscribe from these messages at any time by replying STOP in one of our messages.
  • Modifying Account Information. If you have a Forward account with us, you have the ability to modify certain information in your account (e.g., your contact information and profile picture) through the “Contact Information” tab in the “Account” section in your Forward account. Not all personal information is maintained in a format that you can access or change. If you would like to request access to, or correction or deletion of personal information, you may send your request to us by messaging support in the support portal through your Forward account. We will review your request and may require you to provide additional information to identify yourself, but we do not promise that we will be able to satisfy your request.

9. Privacy Rights

In accordance with applicable privacy law and the jurisdiction in which you reside, you may be able to exercise some or all of the following rights in relation to the personal information about you that we have collected (subject to certain limitations at law):

  • Right of access and portability. You may have the right to obtain access to the personal information we have collected about you and, where required by law, the right to obtain a copy of the personal information.
  • Right to correction. You may have the right to require us to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information.
  • Right to deletion. You may have the right to request the deletion of your personal information, subject to certain exceptions.
  • Right to opt-out. You may have the right to opt-out of certain processing activities. For example, you may have the right to opt-out of the use of your personal information for targeted advertising purposes, or the “sale” of your personal information to third parties in certain contexts. You may also have the right to direct us not to use automated decision-making or profiling for certain purposes.
  • Right to exercise control over sensitive personal information. You may have the right to exercise control over our collection and processing of certain sensitive personal information. 
  • Right to non-retaliation. You may have the right to be free from retaliatory or discriminatory treatment for exercising any of the rights described above.

Before processing your request, we will need to verify your identity and confirm you are a resident of a jurisdiction that offers such right(s). In order to verify your identity, we will generally either require the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. This process may require us to request additional personal information from you. In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.

Unless you have exercised your right to opt-out, we may use your information for all the purposes described in this Privacy Policy, including for targeted advertising. 

You do not need to create an account with us to exercise your right to opt-out. However, we may ask you to provide additional personal information so that we can properly identify you to track compliance with your opt-out request. We will only use personal information provided in an opt-out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems. We may not process your request if we, in good faith, believe that the request is fraudulent. In such instances, we will send a notice to the requestor explaining our decision.

10. Changes to this Privacy Policy

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on the https://www.tryforward.io/, by sending you an email and/or by some other means. 

Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
