Forward: Email Marketing & SMS "the App” provides marketing intelligence software "the Service" to merchants who use Shopify to power their stores. This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.

Please read this Privacy Policy to learn how we treat your personal information. By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Policy. 

Note: This Privacy Policy does not cover the practices of companies we don’t own or control or people we don’t manage.

1. General Provisions

Forward as a Data Controller: For purposes of data protection laws, Forward is the “data controller” (or similar term under applicable laws) and is generally responsible for and controls the processing of your personal information collected through your use of our Service. This Privacy Notice applies only to instances where Forward acts as a data controller.

Forward as a Data Processor:  In providing our Service, our customers may collect data in our products and services, or we may collect data on their behalf, which may include personal information or data about our customers’ end users (“Customer Data”). In such instances, Forward acts as a “data processor” (or similar term under applicable laws), and we have contractually committed ourselves to process Customer Data on behalf and under the instruction of the respective customer, who is the data controller. This Privacy Notice does not apply to the processing of Customer Data and we recommend you read the privacy notice of the respective customer if their processing concerns your personal information.

2. How we collect your data

2.a When you provide Personal Data to us, for example, when you register to and use the Platform, Services, Website, Social, contact us, subscribe to our newsletter, apply for a job position offered by us, etc.

2.b When you install the App, we are automatically able to access certain types of information from your Shopify account like customers, order data, discounts, and more.

2.c When you use our Services, Platform, Website, Social Accounts, such as usage history, your IP address, cookies, preferences, open URL links, etc.;

2.d When we receive Personal Data from other parties, for example, when we receive information from public registers, state or local government institutions or bodies, our partners, other third parties, such as payment institutions, about payments made, etc.;

2.e When your Personal Data, with your consent, is provided to us by other persons, including companies using our Services, for example, when such companies indicate your contacts, refer to you as an authorized person, etc.

2.f Information Collected Automatically

We and our third-party providers and partners collect certain personal information automatically when you visit, interact with, or use our Service.

The Services use cookies and similar technologies such as pixels, clear GIFs, web beacons and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to analyze trends, learn about our user base and operate and improve our Services. Tracking technology

We may use the following technologies currently or in the future to analyze how you use the Platform and Website:

Google Analytics: The Website uses a tool called “Google Analytics” to collect information about use of the Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to this Website. We use the information we get from Google Analytics to maintain and improve the Website and our products. We do not combine the information collected through the use of Google Analytics with personal information we collect. Google Ads: Allows the Website to serve you ads and to draw up reports. All this information is anonymous. Data collected by Google Ads is typically stored on a Google server in the U.S. If you don’t want to receive tailor-made advertising and/or want to opt out of Google Inc. cookies, you can turn off Google Inc. advertising settings at the https://www.google.com/settings/ads by changing your settings as needed. In this case, an opt-out cookie may be entered for you. However, if you delete all cookies, the opt-out cookie may also be deleted.

Google Remarketing: Allows the Website to re-serve you ads on Google partner network sites. If you don’t want to receive tailor-made advertising and/or want to opt out of Google Inc. cookies, you can turn off Google Inc. advertising settings at the https://www.google.com/settings/ads by changing your settings as needed. In this case, an opt-out cookie may be entered for you. However, if you delete all cookies, the opt-out cookie may also be deleted.

Mixpanel: We collect personal information such as your email address and your user activity through the use of Mixpanel. Mixpanel’s ability to use and share information is governed by the Mixpanel Terms of Use, available at https://mixpanel.com/terms/, and the Mixpanel Privacy Policy, available at https://mixpanel.com/privacy/. Hotjar: The Website uses Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users' experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device'sIP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our Website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user. Facebook Pixels and SDKs: We use Facebook pixels or SDKs, which are tools that provide help to website owners and publishers, developers, advertisers, business partners (and their customers) and others integrate, use and exchange information with Facebook, as such the collection and use of information for ad targeting. Please note that third parties, including Facebook, use cookies, web beacons, and other storage technologies to collect or receive information from your websites and elsewhere on the internet and use that information to provide measurement services and target ads. 3. What data do we collect?

We process Personal Data to offer and provide Services, Platform, and Website to fulfil our contractual obligations, as well as pursuing our or third parties’ legitimate interest, in compliance with legal regulations or obligations.

The person providing Personal Data to us is responsible for the correctness, completeness, and relevance of such Personal Data, as well as for the consent of the person whose data is provided to submit his/her Personal Data to us. We may ask you to confirm that the person has the right to provide us with Personal Data (for example, by filling in service orders or registration forms). If necessary (e. g. a person inquires to us about receiving their Personal Data), we will indicate the provider of such Personal Data.

We process Personal Data to operate, improve, understand and personalize our Services.

For example, if you’ve given us your email address, we may send you promotional email offers or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us, which helps us improve our Services. We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. 

For example, the Services use industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of Personal Data you provide to us. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. 

We retain Personal Data about you for as long as you have an open account with us and for six months after termination of your account for archival and billing purposes, or as otherwise necessary to provide you with our Services. 

In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We retain a user’s subscription and purchase history indefinitely for archival purposes.

We do not knowingly collect or solicit Personal Data about children under 16 years of age; if you are a child under the age of 16, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 16 years of age, we will delete that information as quickly as possible. In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems. If we are unable to comply with all or a portion of your request, we will explain the reasons for declining to comply with the request.

Unless you have exercised your right to opt-out, we may use your information for all the purposes described in this Privacy Policy, including for targeted advertising. 

You do not need to create an account with us to exercise your right to opt-out. However, we may ask you to provide additional personal information so that we can properly identify you to track compliance with your opt-out request. We will only use personal information provided in an opt-out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems. We may not process your request if we, in good faith, believe that the request is fraudulent. In such instances, we will send a notice to the requestor explaining our decision.

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to any such changes by placing a notice on the https://www.tryforward.io/, by sending you an email and/or by some other means. 

Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
